Man drove 4x4 at pregnant woman: 'You have anger problem', says judge

A MAN who drove his Land Rover at a heavily pregnant woman walked out of court having served his sentence in custody.
David Gary Marshall, 28, of Thornhill Road, Rastrick, admitted dangerous driving, affray and a public order offence.

Recorder Helen Proops sentenced Marshall to a 10-month jail sentence, but because he had already spent 182 days on remand, he was
released immediately.

Gavin Howie, prosecuting, said Marshall spotted Kimberley Binns outside a shop in Brighouse on January 11.

"She saw a blue Land Rover move on to the pavement and come towards her.

"She jumped out of the way, thinking it would hit her." Marshall shouted abuse at her before driving off. "She was 38 weeks pregnant at the time." said Mr Howie.

Sophie Drake, for Marshall, said Miss Binns was Marshall's ex-girlfriend's sister. A few days before, his ex-girlfriend had been involved in a row with his new girlfriend.

Miss Drake said when Marshall drove at her, he mistakenly thought she was his former girlfriend.

"To scare her, but in no way to harm her, he drove on to the pavement," said Miss Drake.

Marshall said he did not know she was pregnant.

Mr Howie said there had also been an incident at the Old Ship Inn, Bethel Street, Brighouse, in Februuary.

He said Marshall took a glass from the pub and when the licensee confronted him, he bit the glass, smashing it, and spat the remains on the floor.

Bradford Crown Court heard Marshall has previous convictions and in July 2007 was given a 12-month sentence, suspended for two years, after he and a group of others attacked a man in Wyke and broke his jaw after an England World Cup match.

Miss Drake said: "His guilty plea and willingness to pay compensation is a reflection of his remorse."

Marshall was given an 18-month supervision order and told to attend the West Yorkshire Probation Service anger management programme.

He was barred from the Old Ship Inn for two years and banned from driving for 12 months.

Recorder Proops told Marshall: "You are a man who has an anger problem."
